1. INTRODUCTION

Ghale Treks & Expedition Pvt. Ltd. (“Ghale Treks”) is a company incorporated in Nepal, and its website is operated by us. These Terms and Conditions govern the use of our website and the services provided by Ghale Treks.

2. ACCEPTANCE

By accessing, using, or browsing our website or any services provided by Ghale Treks, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

3. DEFINITIONS

In these Terms and Conditions, the following terms shall have the following meanings:

• “Booking” means a booking made by a customer for a trekking or expedition package or other service provided by Ghale Treks.
• “Customer” means a person who makes a Booking or uses the services provided by Ghale Treks.
• “Services” means the trekking or expedition packages, travel arrangements, and other services provided by Ghale Treks.
• “Trekking or Expedition Package” means a package tour offered by Ghale Treks that includes trekking or expedition activities, accommodation, and other services.

4. BOOKING AND PAYMENT

4.1 A Booking is made when a customer submits a booking request to Ghale Treks through our website or through one of our authorized representatives.

4.2 A Booking is confirmed when Ghale Treks sends a confirmation email to the customer.

4.3 Payment terms:

4.3.1 Full payment must be made at the time of booking to secure your reservation.

4.3.2 Payment can be made through our website or via bank transfer.

4.3.3 Customers can pay by credit card with zero commission and no hidden charges.

4.3.4 The transaction prefix “GTE-” followed by the trip title will appear on your credit card statement, confirming that you have paid for or purchased travel activities with Ghale Treks.

4.3.5 Once payment is completed, you will automatically receive an invoice and receipt via email.

5. CANCELLATION AND REFUND POLICY

5.1 Cancellation: If a customer cancels a Booking, Ghale Treks reserves the right to retain any deposit or part of the payment as cancellation fees.

5.2 Refund: If a customer cancels a Booking, Ghale Treks will refund any amount paid minus the cancellation fees.

5.3 Extreme Adventure Trip Cancellations (Mountaineering & Climbing Expeditions)

Ghale Treks & Expedition specializes in extreme adventure trips, including high-altitude mountaineering and climbing expeditions. These journeys involve significant advanced planning, logistical complexity, and non-recoverable costs. The following cancellation policy has been established to reflect these operational realities and is strictly enforced. We strongly advise all clients to review these terms carefully and secure comprehensive travel insurance prior to booking.
5.3.1 Non-Refundable Deposit
A non-refundable deposit, typically 30% of the total trip cost, is required to confirm your booking. This deposit secures your permit, domestic flights, and other initial logistical arrangements. This amount is not refundable under any circumstances if the client initiates the cancellation.

5.3.2 Cancellation Schedule
If you must cancel your trip, the cancellation must be notified to us in writing. The following fees will apply, calculated from the total trip cost and based on the date we receive your written notification:

• Cancellation 60 days or more before departure: The non-refundable deposit will be retained. Any payments made beyond the deposit will be refunded, minus any bank or processing fees.
• Cancellation between 30 and 59 days before departure: 50% of the total trip cost will be charged. The remaining balance (less the initial deposit and any processing fees) will be refunded.
• Cancellation between 15 and 29 days before departure: 80% of the total trip cost will be charged. A partial refund of 20% (less any processing fees) will be issued.
• Cancellation less than 15 days before departure or no-show: No refund will be provided. 100% of the total trip cost is forfeited.

5.3.3. No Refund for Unused Services
Once the expedition has commenced, no refunds will be granted for any unused services. This includes, but is not limited to, accommodation, meals, transportation, or any part of the itinerary missed due to a client’s voluntary withdrawal (e.g., for personal reasons, illness, or injury) or involuntary removal (e.g., due to unsafe behavior or a guide’s decision based on safety or fitness concerns). In such events, the client is responsible for the full trip cost.

Important Recommendation: Travel Insurance
The above policy is strictly enforced. Ghale Treks & Expedition strongly recommends that all clients purchase a comprehensive travel insurance policy that includes coverage for trip cancellation, interruption, medical emergencies, high-altitude evacuation, and repatriation. This is essential to protect your investment against unforeseen circumstances that may prevent you from traveling or force you to leave an expedition early.

• Please ensure all transfer details are entered exactly as stated. Ghale Treks & Expedition will not be held responsible for transfers delayed or lost due to incorrect information provided by the sender.
• The client is responsible for all bank transfer fees incurred during the transaction.

6. CHANGES TO THE ITINERARY

6.1 Changes: Ghale Treks reserves the right to make changes to the itinerary due to unforeseen circumstances such as weather conditions, political unrest, or natural disasters.

6.2 Notification: In the event of changes to the itinerary, Ghale Treks will notify customers promptly.

7. RISK AND RESPONSIBILITY

7.1 Risk: Customers are responsible for their own safety and well-being during the trekking or expedition package.

7.2 Responsibility: Ghale Treks is not responsible for any loss, damage, or injury sustained during the trekking or expedition package.

8. FORCE MAJEURE

8.1 Force Majeure: In the event of unforeseen circumstances such as natural disasters, political unrest, or war, Ghale Treks reserves the right to cancel or modify the trekking or expedition package without notice.

9. INDEMNITY

9.1 Indemnity: Customers agree to indemnify Ghale Treks against any claims, damages, or expenses arising out of or in connection with their use of our services.

10. GOVERNING LAW

10.1 Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of Nepal.

11. DISPUTE RESOLUTION

11.1 Dispute Resolution: Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through arbitration in accordance with the Arbitration Act of Nepal.

12. ENTIRE AGREEMENT

12.1 Entire Agreement: These Terms and Conditions constitute the entire agreement between Ghale Treks and customers, and supersede all prior negotiations, understandings, and agreements between the parties.

13. AMENDMENTS

13.1 Amendments: Ghale Treks reserves the right to amend these Terms and Conditions at any time without notice.

14. EFFECTIVENESS

14.1 Effectiveness: These Terms and Conditions are effective as of 01 Oct. 2024 and supersede all prior versions of our Terms and Conditions.
